Terms and Conditions for Vitality Wellness
Introduction
Welcome to Vitality Wellness (“we,” “our,” or “us”). These terms and conditions (“Terms”) govern your use of our services, website, and facilities located at 1218 S Crescent Ave, Park Ridge, IL 60068 (“Facility”). By accessing or using our services, you agree to comply with these Terms. If you do not agree, please refrain from using our services.

1. Services Provided
Vitality Wellness offers services including, but not limited to:
- Acupuncture and functional medicine
- Fitness and nutrition coaching
- Massage and muscle therapies
- Membership programs (Vitality Base, Premium, Unlimited)
Additional terms may apply to specific services, and by using them, you agree to those additional terms.
2. Eligibility
You must be at least 18 years old to use our services unless accompanied by or with written consent from a parent or legal guardian. By using our services, you represent that you meet this age requirement.
3. Medical Disclaimer
The services provided by Vitality Wellness are intended for general wellness purposes and are not a substitute for professional medical advice, diagnosis, or treatment. Always consult your healthcare provider before starting any fitness or wellness program.
4. Privacy Policy
We are committed to protecting your privacy. Our use of your personal information is governed by our Privacy Policy, which can be reviewed on our website or obtained by contacting privacy@vitality-wellness.net.
5. Membership and Payment
- Membership Terms: Memberships are non-transferable and may be subject to additional terms.
- Payment: All fees are due as stated in the membership agreement. Failure to pay may result in suspension or termination of services.
- Cancellations and Refunds: Members may cancel services or memberships in accordance with the cancellation policy outlined in their membership agreement.
6. Appointments and Cancellations
Appointments must be scheduled in advance. Cancellations or rescheduling must be done at least 24 hours in advance. Late cancellations or no-shows may incur fees as stated in our cancellation policy.
7. Liability Waiver
By using our services, you agree to assume full responsibility for any risk of injury or harm. You release Vitality Wellness, its employees, contractors, and affiliates from all liability for injuries, damages, or losses arising from participation in our services.
8. Facility Rules
To ensure a safe and welcoming environment, all visitors must:
- Follow staff instructions.
- Refrain from disruptive or inappropriate behavior.
- Use equipment and facilities as directed. We reserve the right to refuse service to individuals who do not comply with these rules.
9. Intellectual Property
All content provided by Vitality Wellness, including but not limited to text, images, and logos, is our property or licensed for use. You may not reproduce or distribute any content without our prior written permission.
10. Termination of Services
We reserve the right to terminate or suspend services for violations of these Terms or other policies. Refunds for terminated services will be handled according to the terms of your membership agreement.
11. Changes to Terms
We may update these Terms from time to time. Changes will be effective when posted. Continued use of our services constitutes acceptance of any changes.
12. Governing Law
These Terms are governed by the laws of the State of Illinois. Any disputes will be resolved in the courts of Cook County, Illinois.

Mobile Terms of Service

The Vitality Wellness mobile message service (the “Service”) is operated by Vitality Wellness (“Vitality Wellness”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to Vitality Wellness’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Vitality Wellness through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Vitality Wellness. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP to +18888931712 or click the unsubscribe link (where available) in any text message to cancel. You’ll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Vitality Wellness mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
